Black List is merely a confidential list of firms in foreign countries whose record as regards trading with the enemy is so bad that it is considered undesirable

for British firms to have any dealings with them. (Of

course the question whether a particular firm is in the Statutory List or Class A of the General Black List very often has to be decided on political grounds or grounds

It does not seem

other than its actual character.)

possible therefore for a Colonial Government to place

any definite restrictions on the dealings of a branch

of a Class A firm, but it seems very undesirable that such

respectable

a branch should take orders from British firms which might go to British firms or other responsible firms in

the Colony.

I think therefore that it is quite justifiable to warn firms here not to have any dealings with the Hong Kong branch of this firm and to place such restrictions as can be placed on shipments from this country to the Hong Kong branch. I do not, however, see what restric- tions are possible except the refusal of export licences in the case of shipments for this firm, and this will

of course only cover:

(a) goods exported from this country which are

in Class A of the prohibited export list 1.e. prohibited

to all destinations.

(b) goods transhipped in this country which are

Either

other than in Class A of the prohibited export list,or

in the list of our prohibited imports.

I should certainly be in favour of asking the War Trade Department to refuse licences in such cases, with the proviso at the end of paragraph 4 of this letter
